Poelker v. Doe (1977)

In Brief

Poelker v. Doe (1977): Court upholds city policy prohibiting abortions in city-owned hospitals

The mayor of the City of St. Louis issued a directive prohibiting abortions in city-owned hospitals except where there was a threat of grave physiological injury or death to the mother. An indigent woman who was denied an elective abortion at a St. Louis public hospital filed suit against the mayor claiming the policy infringed upon her constitutional right to abortion and was discriminatory.

The Supreme Court disagreed, ruling that the prohibition of abortion in public hospitals did not restrict her right to abortion. The Court also said that public financing of hospital services for childbirth but not abortion did not violate her right to equal protection of the laws.
